What to Do When Your Work Permit Expires
If you are a foreign teacher in China, keeping track of your work permit's expiration date is essential. Missing the deadline can lead to fines, legal trouble, and even deportation. This guide explains the steps you need to take before your permit expires.
▶ Key Deadlines and Requirements
If your employer plans to renew your contract and keep you in the same teaching position, they must submit an extension application 30 to 90 days before your current work permit expires.
In Beijing, the application window opens 120 days before expiration and closes 30 days before. Applications filed less than 30 days before expiration will no longer be accepted.
Late submission may also disrupt your residence permit, which must be renewed alongside your work permit to avoid legal issues.
What Happens If You Miss the Deadline?
If your work permit expires without renewal or proper handling, you may face the following consequences:
-
Fines – 500 RMB per day of overstay, up to a maximum of 10,000 RMB.
-
Deportation and re-entry bans – Serious overstay can lead to deportation, affecting your ability to return to China in the future.
-
Employment disruptions – An expired permit means you are no longer legally authorized to work. You may need to reapply from outside China.
-
Permanent record – Violations are recorded in China's immigration system. This record may be reviewed in future visa and residence permit applications.
▶ Required Documents for Extension
Prepare the following documents before starting the online application:
1. Application Form for Extension of Foreigner's Work Permit
Complete the form online, print it, sign it, and have your employer stamp it with their official seal.
2. Employment Contract
The contract must be in Chinese, signed by you, and stamped by your employer. It should clearly state your work location, job duties, salary, contract duration, and position title. The new contract's start date should connect seamlessly with your previous contract’s end date, with no gaps.
3. Passport and Valid Work-Type Residence Permit
Provide scanned copies of your passport information page and your current work residence permit page.
4. Chinese Translations of Any Non-Chinese Documents
Any document not in Chinese (excluding your passport) must be accompanied by a Chinese translation. Translations can be prepared in-house by your employer and must be stamped with the employer's official seal.
5. Additional Materials for Certain Cases
If you are applying for extension as a Category A (high-level) talent, you need to provide supporting documents. Some cities also require up-to-date health insurance and a medical examination certificate.
Once the online application is approved, your employer should update the chip information on your Foreigner's Work Permit at the local service window.
▶ What If You Want to Change Jobs?
If you are moving to a new university, you need a transfer process. Here is how it works:
Step 1 – Cancel your current work permit
Your current employer must apply for cancellation within 10 working days after your contract ends. Obtain an official cancellation certificate and a departure certificate.
Step 2 – Apply for a new work permit
Within 30 days of cancellation, your new employer submits a fresh work permit application online.
If your job position remains the same (e.g., still teaching English), you do not need to prepare new documents for your education degree, police clearance certificate, or medical examination.
Step 3 – Update your residence permit
After obtaining the new work permit, apply to update your work-type residence permit at the local Exit-Entry Administration Bureau. Submit your passport, new work permit, accommodation registration form, and application letter.
★ Important: A work permit is always tied to a specific employer. Working for a different institution without updating your permit is considered illegal employment, even if your old permit is still valid.
▶ Upcoming Renewal Trends in 2026
China continues to prioritize bringing in high-quality foreign talent. The Ministry of Education has explicitly included the optimization of the foreign teacher recruitment mechanism into the national education development strategy.
As a result, salary standards have become more strictly enforced for work permit renewals. Starting in early 2026, the salary thresholds for Category A and certain Category B work permits have increased significantly. These thresholds are now automatically verified by the system. Applications that do not meet the salary requirement will be rejected.
For teachers currently working in China, ensuring that your salary meets the updated local standards will be key to a smooth renewal.
